The airbag that's in my car is fine, however if the car was retrofitted with the M5 steering wheel/airbag there's a chance that the M5 airbag could be one that's involved in the multifaceted recall. I take it to read: BMW cannot exonerate themselves of any airbag that is under a recall status. The below BMW vehicle models are affected by the Airbag recall E46 3 Series (Produced from 1998 - 2005) E39 5 Series (Produced from 1995 - 2003) E53 X5 (Produced from 1999 - 2006).
BMW will recall 76,565 vehicles due to a defect in the front passenger seat occupant detection mat. The front passenger seat occupant detection mat determines if and how the passenger frontal air bag should deploy in a crash. This mat may fatigue and develop cracks, which could lead to a system failure. If the electronic sensing mat in the front passenger seat fails, this will disable the front passenger air bag and the air bag will not deploy during a crash.

The BMW vehicles involved in this recall are from older years. They include the 2006 325i, 325xi, 330i and 330xi sedans and 325xi sport wagons, the 2007 328i, 328xi, 335i and 335xi sedans and 328i and 328xi sport wagons, the 2006-7 525i, 525xi, 530i, 530xi and 550i sedans and 530xi sport wagons, the 2006 760i sedans, the 2006-7 750i, 750Li, and 760Li sedans and the 2006 X5 sport utility vehicles. This action is related to a 2008 recall done by BMW regarding the same issue. In 2008, BMW recalled 200,000 vehicles due to a similar problem, but did not recall these vehicles at that time. BMW said it did not recall the additional 77,000 vehicles recalled this week in 2008 because “they had significantly lower warranty claim rates.”

BMW will notify owners with an interim notification letter in January 2014 since parts are not currently available. Parts are expected to be available in March 2014. BMW will send a second letter and dealers will repair the occupant detection mat to eliminate the possibility that it may crack, free of charge. Additionally, owners of model year 2006-2007 3 Series with standard seats, 5 Series with comfort seats, and Z4 models, will receive an extended warranty on their front passenger seat occupant detection mat. Owners may contact BMW customer relations at 1-800-525-7417 or email BMW at CustomerRelations@bmwusa.com.

Americans rely on their car manufacturers to provide a safe well-designed vehicle. Sadly, that is not often the case. The Auto Defect Attorneys at the Brandi Law Firm has successfully represented many people injured from defective Toyotas, Fords, Chryslers, Volkswagens, GM products and numerous other manufacturers and suppliers. Often times, people involved in accidents do not examine the issues of defective vehicle design nor whether the car was truly crashworthy – does it contain the appropriate crash protection. If you or a loved one has been injured in an auto crash, our attorneys at the Brandi Law Firm are available to consult with you. Please contact our office at 800-481-1615 or email us.
